Thanks to Dodgy Reg who after a little bit of surfing managed to find ROMs for MAME on the web.. here: Black

The first major game was superior in both game play and graphics. Released
in 1998 by Rage and GT. The game was set at the time of the original novel
and had many cool links to the Jeff Wayne musical, including some narration
by the late Richard Burton and remixed music. It is a game not unlike
'command and conquer', you can play as the humans or the Martians, defending
or invading territory. The Martians research better heat rays, and the
black smoke. The humans however research heat resistant armour as well
as faster firing weapons to repel the invaders. It is an excellent game,
I especially love the intro sequence for the Martians, where we see a
Martian elder executed by the telepathic beings, and the new elder deciding
to invade Earth, really harks to that feeling you get from the novel that
all the Martians want to do is stay alive. It is a must have for all War
of the Worlds fans and Strategy game fans alike. You can pick it up from
most places on budget these days.
